In March, USCIS conducted its initial random selection process for the fiscal year 2025 H-1B cap. This included properly submitted electronic registrations for both the general H-1B cap and the advanced degree exemption, also known as the master’s cap. Only those petitioners with selected registrations for FY 2025 were eligible to file H-1B cap-subject petitions during the designated filing period from April 1 through June 30, 2024.

Additional Selections Needed

Recently, USCIS determined that additional registrations are necessary to meet the FY 2025 regular cap numerical allocation. As a result, a second round of random selections will soon be conducted. This selection will include unique beneficiaries from the previously submitted electronic registrations. Petitioners with selected registrations from this second round will be notified and will be eligible to file an H-1B cap-subject petition for the beneficiary named in the applicable selected registration. USCIS will announce the completion of this second selection process and notify the selected petitioners accordingly.

No Second Selection for Advanced Degree Exemption

It is important to note that there will be no second selection for the advanced degree exemption. USCIS has already selected enough master’s cap registrations and received sufficient petitions to meet the FY 2025 master’s cap numerical allocation. The second round of selection for the regular cap will include registrations that indicated eligibility for both the master’s cap and the regular cap.

Next Steps for Selected Petitioners

Those with selected registrations will see updates in their USCIS online accounts, including a selection notice. This notice will contain detailed instructions on when and where to file their H-1B cap-subject petitions.
