USCIS has officially announced the opening of the FY 2027 H-1B cap registration period, and this year brings important changes that employers and foreign professionals should understand early.

At Garvish Immigration Law Group, we know the H-1B process can feel complex and high-stakes. Below is a clear breakdown of key dates, requirements, and what’s new for this upcoming season.

Key Dates for FY 2027 H-1B Registration

  • Registration Opens: March 4, 2026 at 12:00 p.m. ET
  • Registration Closes: March 19, 2026 at 12:00 p.m. ET
  • Selection Notifications: Expected by March 31, 2026

During this period, employers (or their attorneys) must electronically register each beneficiary through a USCIS online account and pay the $215 registration fee per beneficiary.

Only registrations selected through this process may move forward to file a full H-1B petition.

USCIS Online Account Requirement

  • Employers must have a USCIS organizational account
  • Attorneys may add employer clients in advance
  • Beneficiary information and registrations can only be submitted starting March 4

Preparation before the registration window opens is critical.

What’s New for FY 2027

Weighted Selection System

USCIS will now use a weighted lottery system if registrations exceed the annual cap. This means:

  • Higher-paid, higher-skilled positions may have better odds of selection
  • Wage levels will play a more meaningful role in the lottery process

If registrations do not exceed the cap, all properly submitted registrations will be selected.

Possible $100,000 Additional Fee

A Presidential Proclamation issued in September 2025 may require some employers to pay an additional $100,000 fee before filing an H-1B petition if their registration is selected. While this does not affect registration itself, it is a major planning consideration.

Why Planning Matters

Between the new selection system, increased fees, and strict filing rules, the FY 2027 H-1B season demands thoughtful preparation. Early legal guidance can help employers:

  • Assess wage levels and eligibility
  • Avoid costly registration mistakes
  • Explore alternative visa options if needed
