Conditional Green Card Holders May Have a 48 Month Extension of Green Card Validity

Petitioners who file Form I-751, Petition to Remove Conditions on Residence, or Form I-821, Petition by Investor to Remove Conditions on Permanent Residence can now have their green card validity extended. Indeed, these petitioners will have an automatic extension of their green card 48 months beyond the green card’s expiration date.

This change became effective on January 11, 2023, for Form I-829 and on January 25, 2023 for Form I-751.

The forms to remove conditions have been updated and now have the language of the extension of the validity of a Green Card for 48 months. The receipt of the removal of conditions applications can be presented with an expired Green Card as evidence of continued status.

Therefore, Green card holders with conditions remain authorized to work and travel for 48 months from the expiration date on the front of their expired Green Card.
